Reform of School Discipline

Recent action by federal regulators, state legislatures, and school districts across the nation reflect the emerging consensus that zero tolerance protocols and other harsh, exclusionary school discipline practices impose serious and unjustifiable harms on students. This session will identify the legal and educational principles that propel an agenda for school discipline reform and will also describe the alternative disciplinary approaches that can provide more effective and more compassionate responses to students' behavioral issues. The session will also briefly explore some unresolved questions regarding the outer boundaries of schools' disciplinary authority and will conclude by considering how to formulate a school discipline reform agenda for South Carolina.
ESSA Update and the SCDE Response

The reauthorization of the Elementary and Secondary Education Act was signed into law in December 2015 as the Every Student Succeeds Act (ESSA). The new ESSA law supports the Profile of the South Carolina Graduate and the 2016-2017 school year will be a transition year for the major programs for ESSA. To implement ESSA, South Carolina needs the input of stakeholders including parents, students, elected officials, education law practitioners, and others to inform and develop the Consolidated State Plan that will be submitted to the US Department of Education for approval. Consultation and coordination of these efforts will take place through December 2016, and stakeholder input will be incorporate into the Consolidated State Plan. The framework for the State Plan will be available to the public, and all stakeholders are encouraged offer general input or specific input about how best to implement ESSA in South Carolina.
