This program by G.P. Diminich discusses how clients in high-liability professions and business endeavors should consider structuring their assets in a manner that reduces potential exposure to claims. By examining Section 15-41-30 (property that is exempt from levy under S.C. law), retirement plans, LLCs, corporations, trusts, real estate titling, and the Bankruptcy Code, this seminar analyzes certain vehicles and structures that can be utilized by attorneys before liability arises to avoid potential creditors, both during lifetime and after death. Also discussed is compliance with the South Carolina's Statute of Elizabeth, which covers transactions defrauding creditors.
