About the Seminar
During these challenging times, lawyers and mediators alike are wondering whether they should give up on doing mediations until the coronavirus threat is over or whether acceptable alternatives exist.
This webinar for mediators and litigators alike will explore online mediations: how to set them up, effectively present in open sessions, work in breakout rooms and reach binding agreements. Online security issues and concerns, including facts and myths surrounding the use of Zoom Meetings in mediation, will also be explored.
Faculty Members:
KARL A. FOLKENS
Karl Folkens practices in Florence, SC, and now focuses primarily on mediation and arbitration. He has presented at CLE's and the Judicial Conference in the areas of advanced mediation techniques; effective advocacy in mediation; arbitration certification; starting a mediation practice; early neutral evaluation (ENE); exploring alternative forms of dispute resolution; mistakes, myths and misunderstandings in mediation; effective use of technology in mediation; conducting online mediations; avoiding impasse in mediation; guardian ad litem certification; applying computer technologies to the practice of law; equitable division of marital and business assets; and legal ethics.
Karl is a Past President of the South Carolina Bar Foundation and the Florence County Bar. He is also a Past Chair of the South Carolina Bar's Dispute Resolution Section. He was a member of the Supreme Court's Joint Commission for ADR. He is a member of the National Academy of Distinguished Neutrals and a founding member of the South Carolina Academy of Mediators and Arbitrators. He has mediated over 4,400 cases and arbitrated over 350 cases.
RICHARD L. HINSON
Richard Hinson has been a member of the South Carolina Bar for nearly 30 years and has over 20 years experience as a mediator and arbitrator. During that time, he has conducted approximately 2,300 dispute resolution proceedings. After 23 years of general litigation and trial practice, he started his own solo practice in 2014 devoted exclusively to mediation and arbitration.
Richard has presented at numerous CLE's on the topics of mediation, arbitration, and ethics. He has served on the South Carolina Supreme Court Commission on ADR, the South Carolina Bar Dispute Resolution Section Council, and is a past president of the Florence County Bar. He is a member of the National Academy of Distinguished Neutrals and the South Carolina Academy of Mediators and Arbitrators. Richard is a native South Carolinian, born and raised in Lancaster County.
ERIC K. ENGLEBARDT
Eric K. Englebardt graduated from the University of North Carolina in 1986, and the UNC School of Law in 1989. Eric has been honored to be included in both Best Lawyers and Super Lawyers as a mediator and as an arbitrator for many years. He is also a member of the National Academy of Distinguished Neutrals and serves on the board of the South Carolina Academy of Mediators and Arbitrators.
Eric feels blessed to have his avocation and vocation be one and the same. A member of both the NC and SC bars, he has practiced his entire career in Greenville, SC, having been a partner at three large firms before seeing the light and joining his friend David Wilson in forming Wilson & Englebardt, LLC, in 2016. About 90% of Eric's practice is serving as a mediator.
