"The inverse condemnation cause of action is an important tool for protecting property rights through enforcement of the Just Compensation clauses in the state and federal constitutions. The courts have developed an extensive body of jurisprudence controlling when the government may be liable to a property owner for physical damage or regulatory diminution in value of property. This course provides an in depth look at the substantive and procedural law that applies to physical and regulatory takings claims in a wide variety of contexts, including different categories of physical takings, "police power" theory, regulatory takings analysis under Penn Central and other U.S. Supreme Court opinions, regulatory delay, regulatory exaction conditions, and interesting recent cases in state and federal court."
