Virtual Civil Mediation Training Program

April 16, 2021 - April 18, 2021


Note: This training will take place over two consecutive weekends, April 16-18 and April 24-25.

The South Carolina Bar CLE Division is pleased to partner with attorney and Florida certified Circuit Civil, County, and Appellate Court mediator ERIC DUNLAP to offer a 40-hour virtual circuit mediation training program.  This fully South Carolina ADR Commission-certified training program will consist of lectures, group discussions, written exercises, and mediation role plays/simulations. Reading materials, including applicable South Carolina ADR statutes, rules of procedure, and rules of conduct designed to supplement the training will be provided to trainees at the training program. Trainees will also be required to reduce an agreement to writing.

Each trainee will be required to participate in at least one continuous role play acting as the sole mediator and at least one continuous role play as the disputant (plaintiff/defendant). During a role play in which the trainee acts as the mediator, trainees will be expected to deliver an opening statement and mediate the dispute to either resolution or for 60 minutes. The objective of the role play is for the trainee to develop confidence and experience as a mediator. Each role play will be conducted under the observation of an experienced South Carolina mediator who will provide a minimum of 20 minutes of oral and written feedback to the trainee/mediator. Observers will provide each trainee with a copy of the written feedback at the conclusion of his or her role play as mediator.

This special 40-hour mediator training will be held in a virtual environment over two consecutive weekends (April 16-18 and 24-25), and will provide each trainee the opportunity to fully engage in large and small group discussions, interactions with the trainer and other participants, participate in oral and written exercises, and benefit from a full range of training experiences.  Attendance is limited to twenty four participants, so register now to reserve your space. 

This program has been approved for MCLE/LEPR credit hours as follows by the SC Supreme Court Commission on CLE. Each day has an assigned  course number. Please see the MCLE Regulations on number of hours earned online.

 About the Trainer

 

ERIC DUNLAP is a certified Circuit Civil, County, and Appellate court mediator, and a federal court mediator for the U.S. Middle District of Florida. Mr. Dunlap obtained his law degree from Cumberland School of Law in 1991, his Masters in Business Administration from Samford University in 1991, and his Bachelors of Science in Business Administration from the University of Central Florida in 1988. In addition to serving as a mediator, Mr. Dunlap serves as an adjunct professor at Barry University School of Law in Orlando, Florida where he teaches Mediation Theory and County Court Mediator Certification courses to students enrolled at the law school. As a Primary Trainer for Florida Supreme Court Certified Circuit Civil, County, and Appellate Mediation programs, Mr. Dunlap offers circuit civil, county, and appellate court mediator certification training sessions to the public. Mr. Dunlap is also an approved arbitrator, and also conducts arbitration training courses for people interested in becoming an arbitrator. Businesses, organizations, and agencies may schedule dispute resolution and training sessions to improve dispute resolution techniques essential for healthy employee/employer relations and client relations. Mr. Dunlap also serves on the Mediator Qualifications Board Central Division, has served on the Mediator Qualifications Complaint Committee, serves on the Alternative Dispute Resolution Rules and Policy Committee, and has been listed as one of “Orlando’s Top Lawyers” in editions of Orlando Home & Leisure.

Day 1: April 16

Day 3: April 18

·         discuss techniques for generating movement;

·         discuss caucus;

·         discuss diversity awareness;

·         discuss the business of mediation and ethical considerations;

·         discuss ending mediation and ethical issues;

·         participate in an exercise for reducing an agreement to writing;

Day 4: April 24

·         discuss ethical issues;

·         discuss basic legal concepts in circuit mediation;

·         discuss the court process;

·         discuss risk assessment and dealing with insurance companies;
