Dram shop litigation is no different. The SC Bar CLE Division is proud to present a balanced and intensely practical program designed to provide both plaintiff and defense counsel with the vital information you will need to successfully prosecute or defend the dram shop or C-Store case.
We are also pleased to offer a unique hour of ethics
delivered by Jeremy Babener and Charles Ledoyen. This presentation will help you
understand that decisions made before settlement of a personal injury claim can impact plaintiffs’ taxes, financial stability, and eligibility for government benefits. Trial lawyers face an evolving duty of care to address these issues unless they compliantly “limit” the scope of their engagement. To do so, you need “informed consent” from the client. This presentation will cover the relevant rules and discuss how to limit the scope of your engagements. It will also help you identify when clients can increase the value of their expected recoveries without demanding more money from defendants.
For most personal injury lawyers, advising on tax, finance, and government benefits is outside your intended “scope of representation.” Remember to obtain “informed consent” from clients to exclude those subjects. To do so, it’s important to disclose potential risks on those issues.
