Live Webinar: Ethics and Easements

This special two-part seminar will address key issues and developments in the law of legal malpractice and the law of easements in South Carolina. Participants will get 6 full hours of MCLE, including up to 3.0 hours of LEPR credit.

Part One of the program is entitled: What’s Next? Emerging Issues in Legal Malpractice law

The morning portion of the seminar will cover emerging issues at the intersection of legal malpractice law, evolving technology, and ethical practice. Join us for an in-depth discussion of how the legal profession is navigating the challenges posed by new technologies, and what that means for the future of legal malpractice claims, as well as a conversation of the national trends in legal malpractice claims and unsettled issues in South Carolina legal malpractice law.

Key topics covered will include:

  • The Intersection of Ethics and Generative AI: As generative AI tools become more integrated into the legal practice, attorneys will face novel and difficult ethical issues surrounding its integration. We will examine the legal and ethical concerns that may arise while using generative AI from document drafting to legal research, and the potential for malpractice arising from reliance on AI-generated content.
  • Unanswered Questions in South Carolina Legal Malpractice Law: This panel will explore ongoing unsettled legal questions in South Carolina legal malpractice law surrounding causation, damages, and other issues, offering insights into what future developments may look like in South Carolina based on other jurisdictions and practice areas.
  • National Trends in Legal Malpractice Claims: Gain valuable insights into the latest trends in malpractice claims, including common pitfalls, emerging risk factors, and preventive measures that can help practitioners avoid liability.

Designed for attorneys of all levels, this portion of our program provides practical takeaways, current legal insights, and guidance on navigating complex ethical and legal challenges. Whether you already practice legal malpractice law or want to learn more about this practice area, this program will provide the knowledge and tools to succeed.

Part Two of the program is entitled Easement Law in South Carolina: A Primer for Practitioners. The afternoon portion of the seminar will provide a comprehensive review of the Bar’s new Second Edition of our Treatise on the Law of Easements in South Carolina, by principal authors Richard M. Unger, R. Brooks Wright and Stuart M. Lee. Additional topics to be covered include an overview and analysis of recent case law by Richard Unger and Joby Castine, a comprehensive discussion of easement surveys by Tom Robertson, analysis and guidance on the law of roads and rights-of-way by Paul de Holczer, and an insightful panel discussion featuring Charleston County Master in Equity Mikell Scarborough, and members of our faculty, including leading authorities Howard Yates and Jim Koutrakos.
