About the Seminar
Attorneys will be presented with a video link and power point (power point included) and will be able to view materials via same power point presentation analyzing certain principles for estate attorneys, including trends, causes of action and risk management.
 
Discussion on the ABA Standing Committee on Lawyers' Professional Liability Study Profile of Legal Malpractice Claims 2012 - 2015 and Ames and Gough claims study with particular attention to the EPT arena. Discussion will also cover some of the root causes of the claims including equitable distribution and fairness issues.
 
Discussion on the privity issues and the erosion of strict privity.
 
Discussion on causes of action and remedies against attorneys in the EPT area including legal malpractice, fraud, elder abuse, conflict of interest and breach of fiduciary duty. Common causes of action including drafting errors, lack of capacity, undue influence, failure to appreciate tax consequences, inappropriate handling of trust assets, failure to know or address changes in the law and self dealing will also be covered.
 
Risk management tips for EPT attorneys, including communications, documentation, disinheritance, tax advice, dabbling, conflict of interest, and undue influence.
